(hereinafter referred to as the "Seller")
§1 General provisions
- These Regulations define the rules for using the Online Store available at www.autolandparts.eu, including the rules for concluding sales contracts, placing orders, making payments, making deliveries, submitting complaints and withdrawing from the contract.
- The store conducts retail and wholesale sales via the Internet, in particular in the field of: passenger cars, vans and SUVs imported from the USA, as well as new and used car parts for vehicles of American and other brands.
- The Regulations are made available free of charge via the Store in a form that enables their acquisition, reproduction and recording.
- Each Customer is obliged to read the Regulations before placing an order.
- In matters not regulated by these Regulations, the provisions of Polish law shall apply, in particular: the Civil Code, the Act of 30 May 2014 on consumer rights, the Act on the provision of services by electronic means and the GDPR.
- Pursuant to Art. 12 of the Act on Consumer Rights, no later than the moment the Consumer expresses his or her will to be bound by the Sales Agreement, the Seller shall provide the Consumer with clear and understandable information on: the main features of the Goods (contained in the description of the Goods), the total price including taxes, delivery costs, the method and date of payment and delivery, the complaint handling procedure, the right and method of withdrawal from the contract, the applicability of the code of good practice (the Seller does not apply the code of good practice within the meaning of Art. 2 item 5 of the Act on Counteracting Unfair Market Practices), methods of communication with the Consumer and the possibility of using extrajudicial means of complaint resolution - this information is included in these Regulations and in the descriptions of individual Goods.
§2 Definitions
- Shop – online service available at autolandparts.eu.
- Seller – Autoland Grzegorz Broniecki, details as in the header.
- Customer – a natural person, legal person or organizational unit without legal personality, making purchases in the Store.
- Consumer – a customer who is a natural person and makes a purchase not directly related to his or her business or professional activity.
- Entrepreneur with consumer rights (PNPK) – a natural person concluding a contract directly related to his/her business activity, when the content of the contract indicates that it is not of a professional nature for that person.
- Goods – a product offered for sale in the Store (vehicle, new or used car part, accessory).
- Sales Agreement – a distance contract concluded between the Customer and the Seller via the Store.
- Order – a declaration of will by the Customer aimed at concluding a Sales Agreement.
- Account – individual Customer panel in the Store.
- Warranty – a voluntary obligation of the manufacturer or importer of a part/vehicle, separate from the Seller’s statutory warranty, granted under the conditions specified in the manufacturer’s warranty card (if such a warranty is granted).
- Working day – a day from Monday to Friday, excluding public holidays in the Republic of Poland.
- Newsletter – a service provided electronically, consisting in the Seller sending e-mail messages containing commercial information to which the Customer has given separate consent.

§4 Technical requirements
- To use the Store, you must have: a device with Internet access, an up-to-date web browser that supports cookies (e.g. Chrome, Firefox, Safari, Edge in the current version), and an active e-mail account.
- The store uses cookies. Detailed information on how they are used is provided in the Cookie Policy available at: autolandparts.eu/policies/cookies.
- The Seller strives to ensure that the Store is accessible to users of all popular web browsers, operating systems, device types, and internet connection types. The minimum technical requirements for using the Store are Internet Explorer 11 or Chrome 66, Firefox 60, Opera 53, Safari 11, or newer.
- Using the Store may involve risks typical of using the Internet (e.g. malware), therefore the Customer is recommended to use security measures (antivirus programs, firewalls).
§5 Account in the Store
- Creating an Account is voluntary and free of charge. Purchases can also be made without registering an Account.
- To create an Account, you must provide an email address and set a password.
- The Customer is obliged to provide true data and to keep the access data to the Account confidential.
- The Customer may delete the Account at any time by sending an appropriate request to the Seller's e-mail address.
§6 Placing orders and concluding a sales contract
- Orders can be placed 7 days a week, 24 hours a day via the Store website.
- Information about the Goods provided in the Store (including descriptions, technical parameters, prices) constitutes an invitation to conclude a contract within the meaning of Article 71 of the Civil Code.
- To place an order, the Customer adds the selected Goods to the basket, then provides the data necessary to complete the order (shipping details, invoice details, selection of payment and delivery method) and confirms the order by clicking the "Buy and pay" button (or equivalent), which is equivalent to placing an order with the obligation to pay.
- When purchasing car parts, the Customer is required to provide accurate vehicle identification data (make, model, year of manufacture, VIN, engine number) in order to select the correct part. The Seller is not responsible for any incompatibility of the Goods with the vehicle if the Customer provides incorrect identification data.
- After placing an order, the Customer will receive confirmation of its acceptance via email at the address provided. The sales contract is deemed concluded upon receipt by the Customer of an email confirming acceptance of the order.
- Pursuant to Article 21 of the Consumer Rights Act, the Seller confirms to the Consumer the content of the proposed contract recorded on a durable medium (e-mail) at the latest upon delivery of the Goods.
- The Seller reserves the right to contact the Customer to verify the order (in particular in the case of vehicles and parts of high value or imported on individual order).
- If the ordered Goods (including Goods imported from the USA) are unavailable, the Seller will immediately, no later than 3 business days, inform the Customer and offer the following options: extending the order completion date, partially fulfilling the order, exchanging it for a Good with similar specifications, or canceling the order with a full refund. Fulfillment of the order in a modified form requires the Customer's approval.
- In the event of an obvious error in the price or description of the Goods (technical error, typo), visible to the average Customer as grossly unmarketable, the Seller reserves the right to contact the Customer to confirm the order at the corrected price, and in the event of non-acceptance – to cancel the order in this part.
- The order may also be canceled by the Seller if it cannot be fulfilled for reasons beyond the Seller's control (e.g. lack of availability of parts on the American market, cessation of import of a given model), of which the Customer will be immediately informed and the funds paid will be refunded.
§7 Prices and payments
- All prices of the Goods given in the Store are gross prices, expressed in Polish zlotys (PLN) [or other currency indicated next to the Goods], and include VAT at the rate of 23%.
- The price given for the Goods at the time of placing the order is binding on both parties.
- Prices do not include delivery costs, which are indicated separately before placing the order.
- For orders shipped outside the European Union, the Customer may be additionally charged customs duties and import taxes applicable in the country of delivery, beyond the Seller's control.
- Available payment methods:
- online payment via the Przelewy24 system (online transfer, BLIK, payment card),
- traditional transfer to the Seller's bank account,
- [cash on delivery – if applicable],
- [installment payment/leasing when purchasing vehicles – if applicable].
- The Seller issues VAT invoices to business customers. To receive an invoice, the Customer must provide the required company information (name, tax identification number, and address) on the order form.
§8 Delivery
- The Seller delivers within the territory of the Republic of Poland, within the European Union and outside its borders.
- Delivery is carried out via courier companies [name of company/courier companies], and in the case of vehicles – by specialized transport (trailer) or personal collection.
- The order completion date includes the time of completing the Goods and the time of delivery by the carrier and is indicated for each Good or in the order confirmation.
- In the case of Goods imported on individual order from the USA, the delivery time may be extended, of which the Customer is informed individually before or after placing the order.
- The customer is obligated to inspect the shipment upon delivery in the presence of the carrier. If any damage is detected, it is recommended to complete a damage report, which will facilitate any potential complaints.
§9 Right of withdrawal from the Agreement (applies to Consumers and Entrepreneurs with consumer rights)
- A consumer and a PNPK who has concluded a distance contract may withdraw from it within 14 days without giving any reason and without incurring any costs, except for the costs specified in paragraph 6 below.
- The deadline for withdrawal from the contract begins on the day on which the Consumer takes possession of the Goods (or on which a third party indicated by him does so).
- To withdraw from the contract, the Consumer must submit an unequivocal declaration of withdrawal to the Seller, e.g., electronically to autoland@autoland.net.pl or in writing to the Seller's registered office address. To meet the deadline, it is sufficient to send the declaration before its expiry.
- The Seller shall immediately, no later than within 14 days from the date of receipt of the declaration of withdrawal, return to the Consumer all payments made by him, including the costs of delivery of the Goods (except for additional costs resulting from the method of delivery chosen by the Consumer other than the cheapest standard delivery method offered by the Seller).
- The Seller shall refund the payment using the same method of payment as used by the Consumer, unless the Consumer has expressly agreed to a different method of refund.
- The Consumer bears the direct costs of returning the Goods, unless the Seller has agreed to bear them.
- The Consumer is liable for any reduction in the value of the Goods resulting from their use in a way that goes beyond what is necessary to establish the nature, characteristics and functioning of the Goods.

The right of withdrawal does not apply in relation to contracts in which the subject of the performance is:
- Non-prefabricated goods, manufactured according to the Consumer's specifications or intended to meet his individual needs - this applies in particular to car parts imported/ordered individually for a specific vehicle (VIN number) at the Customer's request,
- vehicles imported at the customer's individual request with parameters specified by him,
- Goods which, due to their nature, are inextricably linked to other items after delivery.
- The model withdrawal form is attached as Annex 1 to these Regulations (optional form).
§10 Warranty and complaints
- The Seller is obliged to deliver the Goods free from defects and is liable to the Customer who is a Consumer or PNPK under the warranty in accordance with the principles set out in the Civil Code and the Consumer Rights Act.
- Used Goods – Pursuant to Article 568 § 1 of the Civil Code, when selling used goods, the Seller's warranty liability to the Consumer may be shortened, but not less than one year from the date of delivery of the Goods. Information about any shortened warranty period, as well as the technical condition, mileage, and visible signs of use of the given part, is always provided in the description of the Goods before purchase.
- Complaints may be submitted electronically (autoland@autoland.net.pl) or in writing to the Seller's registered office address, describing the defect of the Goods and the Customer's request (repair, replacement, price reduction, withdrawal from the contract).
- It is recommended, although not mandatory, that the complaint includes: the Customer's name and surname, order number or proof of purchase, a detailed description of the defect and the date of its occurrence, as well as attached photographic documentation of the defect (if possible) and the VIN number of the vehicle for which the part was intended.
- The Seller will respond to the Consumer's complaint within 14 calendar days of receiving a complete complaint. Failure to respond within this timeframe will mean the complaint is deemed justified.
- If the complaint is accepted, the costs of returning the defective Goods and re-shipping the defect-free Goods shall be borne by the Seller.
- In the case of Customers who are neither Consumers nor PNPKs, liability under the warranty is excluded in accordance with Article 558 § 1 of the Civil Code.
- Complaints regarding services provided electronically (operation of the Store) can be submitted to the Seller's e-mail address; the Seller will consider them within 14 days.
§11 Manufacturer's warranty
- Regardless of the Seller's liability under the warranty, some Goods (in particular new original parts) may be covered by the manufacturer's or importer's warranty.
- Warranty rights should be exercised in accordance with the terms and conditions set forth in the warranty card included with the Product. The warranty for the Product does not exclude, limit, or suspend the Customer's rights under the warranty provisions for defects in sold goods.
- The Seller is not a guarantor within the meaning of the Civil Code, unless expressly stated otherwise in the description of the Product. Warranty rights are exercised directly by the guarantor indicated in the warranty card, and the Seller supports the Customer in this process to the extent possible.
- Used goods are generally not covered by the manufacturer's warranty - they are sold under the warranty described in §10.
§12 Extrajudicial methods of handling complaints and pursuing claims
- The consumer has the option of using out-of-court complaint resolution methods, including: a permanent consumer arbitration court, the provincial inspector of the Trade Inspection, and the district/municipal consumer ombudsman.
- The consumer may also use the EU ODR online platform, available at: ec.europa.eu/consumers/odr.
- Detailed information on out-of-court complaint resolution methods is available on the website of the Office of Competition and Consumer Protection (uokik.gov.pl).
§13 Customers who are not Consumers (B2B)
- The provisions of this paragraph apply to Customers who are not Consumers or Entrepreneurs with consumer rights.
- The Seller has the right to withdraw from the Sales Agreement concluded with such a Customer within 14 days from the date of its conclusion, without giving any reason.
- The Seller's liability under the warranty is excluded.
- The Seller's liability towards such a Customer, regardless of its legal basis, is limited to the value of the placed order, and the Seller is not liable for lost profits.
- Any disputes arising between the Seller and a Customer who is not a Consumer or PNPK shall be submitted to the court having jurisdiction over the Seller's registered office.
§14 Personal data
The principles of processing Customers’ personal data, including the purposes and basis of processing, data storage periods and Customers’ rights, are described in a separate Privacy Policy, available at: autolandparts.eu/policies/privacy-policy.
§15 Provisions regarding international shipping
- For orders placed outside the territory of the Republic of Poland, the Customer is obliged to familiarize himself with the local customs and tax regulations in force in the country of delivery.
- The seller is not responsible for any delays in delivery resulting from customs clearance or for any additional customs and tax fees charged by the customs authorities of the recipient country.
- If the Customer refuses to accept the shipment for reasons attributable to him (e.g. refusal to pay customs duties), the costs of returning the shipment to the Seller shall be borne by the Customer.
§16 Opinions about the Goods
- The Seller allows Customers who have purchased a given Product to post opinions about that Product.
- Reviews should be accurate, truthful, and relate solely to the purchased product or order processing. Posting content that is unlawful, vulgar, violates the personal rights of third parties, or is unrelated to the subject of the review is prohibited.
- The Seller ensures that the published opinions come from Customers who actually purchased the given Goods in the Store - verification is carried out by linking the opinion with the order number.
- The Seller reserves the right to remove an opinion that violates the provisions of paragraph 2, after notifying the author of the opinion, if possible.
§17 Newsletter
- The Customer may voluntarily consent to receiving the Newsletter by providing his/her e-mail address in the subscription form and confirming the subscription (double opt-in).
- The newsletter is a free service, provided for an indefinite period.
- The Customer may at any time unsubscribe from receiving the Newsletter by clicking on the unsubscribe link provided in each message or by submitting such a request to the Seller's e-mail address.
§18 Promotions and discount codes
- The Seller may organize periodic promotions, sales and provide discount codes on the terms specified each time in separate regulations of a given promotion, posted in the Store.
- Unless the terms and conditions of a given promotion state otherwise, discounts cannot be combined.
- Promotional prices are binding on the Seller only during the promotional period or while stocks covered by the promotion last.
- Pursuant to Article 4, Section 2 of the Act of 9 May 2014 on Information on the Prices of Goods and Services, in each case of a price reduction for a Good, the Seller shall provide, in addition to information about the reduced price, information about the lowest price for that Good that was in effect during the 30 days prior to the introduction of the reduction. If the Good is offered for sale for a period of less than 30 days, the Seller shall provide the lowest price in effect during the period from the date the Good was first offered for sale.
- The provisions of paragraph 4 do not apply to Goods that spoil quickly or have a short shelf life.
§19 Force majeure
The Seller shall not be liable for non-performance or improper performance of obligations arising from the Sales Agreement if this is caused by force majeure circumstances (including natural disasters, acts of war, state of emergency, strikes, decisions of public administration bodies, interruptions in the supply of electricity or telecommunications services, significant delays in international transport beyond the Seller's control).
§20 Intellectual Property
- All materials posted in the Store, including logos, photos, descriptions of the Goods, graphic elements and page layout, are subject to the copyright of the Seller or entities with which the Seller has concluded appropriate agreements, and are subject to legal protection.
- Copying, distribution or other use of these materials without the written consent of the Seller is prohibited, except for use within the scope of permitted personal use.
§21 Final provisions
- The Seller reserves the right to make changes to the Regulations for important reasons, in particular changes in legal provisions, changes in payment and delivery methods, and changes in the scope of the Store's activities.
- Amendments to the Regulations do not affect Sales Agreements concluded before the amendments enter into force.
- Customers with an Account will be informed about changes to the Regulations electronically at least 7 days in advance.
- The Regulations come into force on the date of publication on the Store's website.
